0. Company identity
“We,” “our,” and “the company” refer to Wander Free Peru E.I.R.L., a legally registered travel agency operating in Peru. We work with a network of licensed local partners, guides, and transportation providers to deliver travel services under the terms described in this document.
1. Booking and payment
1.1. All tours must be paid 100% in advance unless explicitly agreed otherwise or if our payment platform offers an installment payment option.
1.2. Payments must be made via the agreed method. Any bank transfer fees, currency conversion fees, or payment processing fees are the responsibility of the client.
1.3. The booking is valid only for the individuals specified at the time of booking. Changes to the number of travelers may require price adjustments and are subject to availability.
1.4. The Terms & Conditions are provided to the traveler via our website and through the payment platform. It is the client’s responsibility to read and save these before booking a tour.
1.5. By making the payment, the client acknowledges and agrees to these Terms & Conditions. Any later updates do not affect this booking unless agreed upon in writing by both parties.
1.6. Travelers must provide an emergency contact (name, phone number, and relationship) when booking. This will only be used in case of an emergency during the tour. It is travelers’ responsibility providing an emergency contact.
1.7. Communication Responsibility
It is the traveler’s responsibility to ensure they are reachable via email or WhatsApp in the days leading up to their tour. Important information such as pickup time, itinerary changes, or last-minute updates will be sent through at least one of these channels.
Failure to read or respond to messages may result in missed services, for which no refund or rescheduling will be issued.
1.8. Travel documents and entry requirements
Travelers are responsible for ensuring they meet all passport, visa, vaccination, and other entry requirements for Peru and any regions visited.
We are not responsible for issues arising from invalid documents, denied boarding, or lack of entry requirements.
No refunds will be issued in such cases.
1.9. Right to update terms & conditions
Wander Free Peru E.I.R.L. reserves the right to update, modify, or replace these Terms & Conditions at any time without prior notice.
The version of the Terms & Conditions that is valid at the time of booking will apply to that booking, unless otherwise agreed in writing by both parties.
We encourage travelers to review the most current version available on our website before booking or beginning their tour.
2. Cancellations and modifications
2.1. Cancellations must be made in writing via email or through our official WhatsApp number.
2.2. The following cancellation policy applies:
- More than 30 days before the tour: Refund minus a 10% administration fee.
- 15 to 30 days before the tour: 50% of the total tour price will be charged.
- Less than 15 days before the tour: No refunds will be issued.
- No-shows (failure to arrive at the scheduled meeting point on time) are treated as last-minute cancellations. No refunds or rescheduling will be allowed.
2.3. Cancellations due to illness, injury, or medical emergencies are subject to the same cancellation policy.We strongly recommend that travelers purchase comprehensive travel insurance to cover unexpected cancellations due to health issues. No exceptions will be made outside of our stated refund policy, regardless of documentation provided.
2.4. Machu Picchu tickets, train tickets, flights, and other non-refundable services are always 100% non-refundable, non-changeable, and non-transferable, regardless of cancellation date or circumstances(including force majeure, illness, or personal reasons).
2.5. If a traveler chooses to cancel part of the tour or skip an activity, no refunds will be provided for unused services.
2.6. If a tour component (e.g., hotel or transport) becomes unavailable after payment, we will offer an alternative of similar value or a refund for that specific component, excluding non-refundable tickets.
2.7. For the following tours — and any other tour partially or fully operated by one of our local or international partners — the partner’s own Terms & Conditions, including cancellation and refund policies, apply in addition to our own policies:

If there is a contradiction between our Terms & Conditions and those of a partner, our Terms & Conditions will take precedence, unless the partner’s policies are more restrictive, in which case the more restrictive policy applies. The client is responsible for reading and understanding the Terms & Conditions of any partner involved in their tour. These are available on the partners’ websites or can be provided upon request.
2.8. Shared transport services (e.g., Chivay–Cusco, Cabanaconde–Cusco)
When booking shared transport services through us (such as the tourist bus from Cabanaconde to Cusco or Chivay to Cusco), the ticket is considered non-refundable from the moment of booking. This is because departure must be secured for all participants, and last-minute cancellations impact the service for other travelers.
No refunds will be issued if a traveler cancels their spot, regardless of the reason.
2.9. Rescheduled tours & conditional departures
If a traveler agrees to reschedule their tour to a new date upon our suggestion or at their request, and the new departure depends on a minimum number of participants, the booking becomes non-refundable once the reschedule is confirmed. In the event that the rescheduled tour is later canceled (by us) due to not meeting the required group size, no refund will be provided. However, we will do our best to offer alternative solutions of similar value, such as joining another departure, changing the destination, or upgrading to a private service (additional costs may apply). Please note that rescheduling is not always possible, and we reserve the right to decline a reschedule request at our discretion and without obligation to provide justification. Travelers are responsible for understanding that rescheduled group tours are always conditional on availibility such as, but not limited to, minimum participant numbers and do not guarantee a confirmed departure unless stated otherwise. We strongly recommend purchasing travel insurance to cover cancellations or schedule changes.
2.10. Force Majeure
We are not liable for cancellations, delays, or changes to your tour due to force majeure events beyond our control. These include but are not limited to: natural disasters, road blockades, strikes, civil unrest, weather events, pandemics, or government restrictions.
In such cases, we will attempt to reschedule or adjust the itinerary. However, refunds are not guaranteed and additional costs may apply.
We strongly recommend purchasing travel insurance that covers force majeure disruptions.
2.11. Substitution of services
If we must change a component of your tour due to safety, weather, logistical, or operational issues, we will substitute it with a service of equal or higher value whenever possible.
Changes do not entitle the traveler to refunds unless the substitute is of significantly lower quality and no suitable alternative is offered.
2.12. Pandemic or global disruption policy
In the event of a pandemic, government-imposed travel restriction, or other global event that prevents us from delivering the tour as scheduled, we will offer you an open-date travel credit valid for up to 12 months from the original tour date.
No refunds will be issued in such cases. Rebooking is subject to availability and updated pricing at the time of rescheduling.
This clause falls under our force majeure policy and is designed to ensure future flexibility while maintaining the sustainability of our operations.
3. Exclusions & assumption of risk
3.1. We do NOT provide any form of insurance under any circumstances. This includes but is not limited to health insurance, accident insurance, travel insurance, liability insurance, lost luggage insurance, or trip cancellation insurance.
3.2 The traveler acknowledges and voluntarily accepts that activities such as hiking, mountain biking, rafting, and other adventure sports involve inherent risks. These may include, but are not limited to: physical exertion, altitude sickness, environmental conditions, slips, falls, injuries, wildlife encounters, unpredictable weather, and accidents involving transport or equipment.
Specific risks in high-altitude environments include hypothermia, lightning strikes, and sudden weather changes. These risks exist even when following the guide’s instructions and are beyond the control of Wander Free Peru E.I.R.L.
By participating, the traveler accepts full responsibility for their safety and agrees that the company is not liable for any injury, illness, or death caused by natural elements. The presence of a guide or safety equipment does not eliminate these risks.
3.3. Lost or damaged personal items
All travelers are fully responsible for the safety of their personal belongings during the entire tour. This includes items left in vehicles, hotels, lodges, boats, campsites, or carried during activities.
We are not liable for lost, stolen, or damaged items under any circumstances, including damage caused by weather, transport, third parties, or wildlife.
For trekking tours or itineraries involving porters, mules, boats, or shared transport, we recommend not packing fragile or valuable items in luggage that is carried separately from you.
We strongly advise leaving high-value items (e.g., electronics, jewelry, large amounts of cash) at your hotel or secure storage.
Travel insurance covering loss or theft of personal property is highly recommended.
3.4. Health & fitness requirements
Certain tours, especially those involving trekking or high-altitude travel, require a good level of physical fitness. It is the traveler’s responsibility to assess their own health and capability before booking.
We are not responsible for injuries, altitude sickness, or other issues resulting from inadequate preparation. We reserve the right to exclude a traveler from parts of a tour if we believe participation would endanger their safety or the group.
Pregnancy must be disclosed at the time of booking. For travelers over 70 or with significant health conditions, we may request a recent medical certificate confirming fitness for high-altitude or adventure activities.
3.5. Rental equipment
Travelers are responsible for any equipment they rent from us or our partners. Significant damage, loss, or theft of rented items may incur replacement or repair costs, which must be paid before the end of the tour.
3.6. Physical fitness and participation requirements
Our tours may involve hiking, biking, rafting, and other physically demanding activities, often at high altitude or in remote areas.
By booking, you confirm that you are physically and medically fit to participate. If in doubt, consult a doctor before travel.
We reserve the right to exclude participants from an activity if their health or fitness poses a risk to themselves or the group.
3.7. Altitude risks
Many of our tours occur above 3,000 meters (10,000 ft). Altitude sickness can affect anyone, regardless of fitness level.
It is your responsibility to arrive early enough to acclimatize (recommended 3 days).
We are not responsible for illness caused by altitude or for costs related to early withdrawal from a tour.
3.8. Jungle & wildlife tours
Our jungle tours take place in remote rainforest environments, often hours away from the nearest town or clinic. Travel involves boat transfers, walking through muddy or uneven terrain, and exposure to insects, heat, and rain.
While we take all reasonable precautions, the jungle is a wild environment and wildlife sightings are never guaranteed. Itineraries may change depending on weather, river conditions, or safety concerns.
We are not responsible for delays or modifications caused by river levels, storms, or other natural factors beyond our control.
3.9. Water-based activities (rafting, kayaking, boat tours)
Participation in any water-based activity is at your own risk. Travelers must follow all safety instructions provided by our guides or local partners. While we aim to offer appropriate safety gear, such as life vests, in some remote areas this equipment may not always be available due to logistical limitations or local provider standards. It is the traveler’s responsibility to ask whether safety equipment is provided and to decide whether they are comfortable participating under the given conditions. If a traveler chooses not to participate due to lack of safety equipment, no refunds will be issued for the missed activity. We are not responsible for personal items lost or damaged during river or boat excursions (including phones, cameras, or electronics). In case of dangerous river or weather conditions, we may cancel or modify the itinerary without prior notice. No refund will be issued for force majeure events.
3.10. Delays and changes during tours
In remote areas, delays due to road conditions, strikes, weather, or operational issues are possible. While we strive to follow the planned itinerary, flexibility is essential.
We are not responsible for missed onward travel (e.g., flights, buses, trains) due to delays or route changes during the tour. We recommend scheduling onward travel with sufficient buffer time after the end of your tour.
3.11. Emergency evacuation
In case of a medical emergency during remote tours (e.g., treks or jungle), evacuation costs are the responsibility of the traveler. These costs may include transportation by mule, stretcher, boat, or vehicle to the nearest medical facility.
We strongly recommend travel insurance that includes emergency evacuation coverage.
3.12. Itinerary flexibility
All itineraries are subject to change based on weather, road conditions, local strikes, operational requirements, or safety concerns. While we do our best to follow the published schedule, we reserve the right to alter the itinerary without prior notice.
These changes do not entitle the traveler to a refund, partial or otherwise. We appreciate your understanding and flexibility, especially in remote or unpredictable regions of Peru.
3.13. Luggage handling and oversized items
You are responsible for your luggage at all times. Luggage may be handled by porters, drivers, or boats, and may be exposed to rough conditions.
We are not liable for lost, damaged, or delayed luggage. Avoid packing valuables or fragile items. Oversized luggage may incur additional fees.
3.14. Limited access to medical care
In many remote regions of Peru, especially during treks or jungle tours, access to immediate medical care may be limited or unavailable.
By booking, you acknowledge and accept that emergency medical response times may be delayed, and the level of available care may not match that of your home country.
We are not liable for the outcome of any medical situation or treatment, including delays in accessing care, complications during evacuation, or lack of available services.
3.15 Shared transportation for small groups
If your confirmed tour departure consists of a small group of participants (e.g., only 1–5 people), Wander Free Peru E.I.R.L. reserves the right to arrange transport in the same vehicle with travelers from another departure. We do this to ensure cost-effective and environmentally responsible operations. By booking, you acknowledge and accept that, on departures with very small group sizes, you may share a van, bus, boat, or other transport with travelers not on your exact tour.
3.16. Wildlife sightings disclaimer
While our jungle tours take place in some of the most biodiverse regions of Peru, wildlife sightings are never guaranteed. The presence of animals such as monkeys, jaguars, macaws, river otters, or other species depends on weather, season, time of day, and pure chance.
Our guides do their best to maximize opportunities for wildlife viewing, but the jungle is an uncontrolled natural environment.
We are not responsible for missed sightings or changes in wildlife behavior. No refunds or partial reimbursements will be issued in cases where specific animals are not seen.
3.17. Food, dietary restrictions, and allergies
We strive to accommodate dietary preferences (e.g., vegetarian, vegan, gluten-free) when informed in advance. However, due to remote locations, limited local resources, or third-party providers (e.g., lodges, camps, local families), we cannot guarantee full compliance with all dietary requests. Travelers with food allergies or medical dietary restrictions must inform us in writing at the time of booking. While we do our best to communicate these needs to our partners, travelers are ultimately responsible for managing their own dietary requirements and carrying necessary medications (e.g., EpiPens). We are not liable for adverse reactions or illnesses resulting from food served during the tour, including but not limited to cross-contamination, miscommunication by third-party providers, or unexpected ingredients.
3.18. Hygiene and sanitation conditions
Some tours involve basic accommodations or remote campsites with limited access to showers, clean water, or Western-style toilets. While we and our partners strive to maintain reasonable hygiene standards, we are not liable for illnesses, infections, or discomfort caused by local sanitation conditions.
Travelers should bring personal hygiene products and take standard precautions, such as using hand sanitizer and avoiding unsafe water.
3.19. Swimming and water contact activities
Some tours or lodges may offer opportunities to swim in rivers, lakes, or pools. Participation is entirely optional and at the traveler’s own risk.
We cannot guarantee the cleanliness, depth, presence of wildlife, or water quality of natural bodies of water.
We are not responsible for infections, injuries, or illnesses (e.g., parasites, rashes) resulting from water contact.
Travelers should consult their doctor regarding waterborne risks in the Amazon and remote areas.
3.20. Environmental health risks
Traveling in tropical or highland regions of Peru involves exposure to insects (e.g., mosquitoes, ticks), parasites, and potential pathogens (e.g., Dengue, Leptospirosis).
We recommend using insect repellent, wearing long clothing, and consulting a travel clinic prior to your trip for up-to-date health advice and vaccines.
We are not liable for illness, infection, or allergic reaction resulting from exposure to natural environments or wildlife.
3.21. Group dynamics and shared experiences
On group tours, schedules and walking pace may vary based on the abilities of individual travelers. Our guides are trained to manage diverse groups, but some flexibility is required.
By booking a group tour, you acknowledge that you may need to adjust to the group’s pace, timing, and overall flow of the itinerary.
If you wish to explore independently or need to leave the group temporarily, please notify the guide. We are not responsible for missed activities if you separate from the group.
3.22. Language of service
Group tours are typically conducted in English and Spanish. While we strive to ensure key information is clearly communicated, travelers should have a basic understanding of at least one of these languages or travel with a translator.
We are not responsible for miscommunications due to language barriers if no translator is present.
3.23. Participation of minors
Travelers under the age of 18 must be accompanied by a parent or legal guardian.
By booking a tour that includes a minor, the adult confirms they have the legal authority to consent on behalf of the minor and agree to all Terms & Conditions herein.
We reserve the right to request documentation proving parental or legal guardian status.
4. Release of liability & indemnification
4.1. By booking a tour, the traveler expressly agrees to release, waive, and discharge our company, its owners, employees, partners, agents, and affiliates from any liability for personal injury, death, property damage, financial loss, or any other harm arising from participation in any activity, whether caused by negligence or otherwise.
4.2. The traveler agrees to hold harmless and indemnify our company from any claims, demands, or lawsuits brought by third parties (e.g., family members, insurance providers, legal representatives) due to the traveler’s participation in any activity.
4.3. This release and indemnification agreement applies to the traveler’s heirs, next of kin, administrators, assigns, and legal representatives in the event of the traveler’s death or incapacity.
4.4. The traveler acknowledges that they are not relying on any verbal or written statements made by our company, our guides, or our partners regarding the safety, risks, or conditions of the activities beyond what is explicitly stated in these Terms & Conditions.
4.5. Code of conduct
Travelers are expected to behave respectfully toward guides, staff, local communities, and fellow travelers.
We reserve the right to exclude any traveler from a tour without refund if their behavior is disruptive, dangerous, or under the influence of drugs or alcohol during any part of the tour.
4.6. Maximum liability
To the fullest extent permitted by law, the total liability of Wander Free Peru E.I.R.L. for any claim arising from your tour, whether in contract, tort, or otherwise, is limited to the total amount paid for the specific tour or service in question.
We are not liable for indirect, incidental, special, or consequential damages, including but not limited to loss of enjoyment, emotional distress, or lost vacation time.
5. Payment terms & conditions
5.1. 100% payment is required unless otherwise agreed or if an installment option is available through our payment platform.
5.2. If the payment is made in two parts, both payments must be made in the same currency, unless our payment platform offers the option to pay in different currencies. If our payment platform supports multiple currencies, the traveler may choose a different currency from the available options. All bank transfer fees, currency conversion fees, and payment processing fees are the responsibility of the client.
5.3. No entry tickets, transportation tickets, Machu Picchu permits, or confirmations will be issued until full payment is received.
5.4. Accommodation standards
We work with various accommodations — hostels, hotels, ecolodges, and homestays. Facilities and standards may vary, especially in rural or remote areas. In rural or remote areas, amenities such as hot water, internet, or private bathrooms may not be available, even in standard accommodations
Room types may include twin beds, matrimonial beds, or shared dorms, depending on the tour and availability. Solo travelers may be paired with another traveler of the same gender, unless a private room is requested in advance (additional fee applies).
We cannot guarantee specific room features (e.g., hot water, Wi-Fi, private bathroom) unless explicitly confirmed in writing.
No refunds are provided for dissatisfaction with accommodation matching the category described in your itinerary.
5.5. Homestays and local experiences
Homestays offer a cultural experience and may involve basic shared rooms, limited amenities, and local food.
By booking a homestay, you agree to these conditions. Respectful behavior is essential.
5.6. Transport delays and third-party issues
We use local transport providers (buses, vans, boats, trains). Delays or breakdowns may occur and are outside our control.
We are not responsible for missed onward travel due to these issues. Please allow extra time in your travel plans.
5.7. Flights booked through us
If we book flights for you, we act only as intermediary. The airline’s policies apply.
We are not responsible for delays, cancellations, overbooking, or baggage problems. Flight changes may incur fees. Always check baggage limits and reconfirm departure times.
5.8. Payment platform (WeTravel)
All payments are processed through a third-party platform (e.g., WeTravel), and are subject to the platform’s own terms, conditions, and technical limitations.
Wander Free Peru E.I.R.L. is not responsible for delays, payment failures, currency exchange differences, or errors that occur due to the platform or the user’s payment method.
By booking, the traveler agrees to use the platform responsibly and contact them directly for platform-related technical support if needed.
5.9. Non-refundable special offers
Some discounted tours or special promotions may be offered at non-refundable prices.
If a tour is classified as a “special offer,” it will be clearly indicated at the time of booking.
These bookings must be paid in full at the time of reservation and cannot be changed, refunded, or rescheduled, regardless of the reason.
6. Refund processing & non-refundable costs
6.1. Refund method & timeline
All eligible refunds will be processed to the original method of payment via our payment platform within 30 days of written confirmation of cancellation.
If payment was made by credit or debit card, the refund will be credited back to the same card used at checkout.
Please note:
- Currency exchange rates at the time of refund are calculated by the payment platform (WeTravel), and may differ from the original rate at the time of purchase.
- We have no control over exchange rate differences or delays imposed by your bank or card provider.
- We are not responsible for any financial loss resulting from currency exchange rate differences at the time of refund.
6.2. Non-refundable costs
Certain third-party costs are always non-refundable, including but not limited to:
- Inca Trail permits
- Machu Picchu or archaeological site entrance tickets
- Train tickets
- Flights and airline booking fees
- Travel insurance purchased independently or through us (if applicable)
These costs are paid immediately and are non-recoverable. In the case of cancellation, we will provide a breakdown of any such non-refundable items upon request.
7. Photography & marketing consent
7.1. We may take photos or videos during tours for promotional purposes.
7.2. By participating, travelers grant permission for their image to be used in our marketing materials. No financial or other compensation will be provided.
7.3. If a traveler does not wish to appear in photos, they must inform us in writing before the tour.
8. Governing law & dispute resolution
8.1. This agreement is governed by Peruvian law.
8.2. Dispute resolution
Any disputes shall first be attempted to be resolved amicably through mutual communication.
If no agreement is reached, all claims or disputes shall be submitted exclusively to the competent courts of Huánuco, Peru, in accordance with Peruvian law.
By booking, the traveler waives the right to bring legal proceedings in any other jurisdiction.
9. Website and marketing disclaimers
9.1. Website information and accuracy
We do our best to keep all information on our website accurate and up to date. However, due to the nature of travel in Peru, details such as itineraries, availability, accommodation, and included services may change without notice.
Photos, maps, and descriptions are for illustrative purposes only and may not reflect the exact experience at the time of your travel.
Wander Free Peru E.I.R.L. is not liable for misinterpretations or outdated content viewed on our website or partner sites.
9.2. Marketing materials and photographs
Photos and videos used in marketing materials, social media, and on our website are intended to give a general sense of our tours and destinations.
Actual conditions (weather, wildlife sightings, vehicle models, hotel rooms, group size, etc.) may vary. We do not guarantee that the tour will match any specific promotional image or video.
We make reasonable efforts to represent our services accurately but cannot guarantee full visual or descriptive alignment.
